Work at home schemes represent a substantial loss of money for U.S. residents. While the numbers of all losses from work at home schemes have yet to be tabulated, those that resulted in action by the Federal Trade Commission (FTC) were valued at consumer losses of over $100 million. In California alone, one of the states hardest hit by work at home schemes, consumers and would be home business owners, lost over $250,000 due to this type of fraud. The attorney general for the state of California announced last February that the state and the federal government were working hand in hand to crackdown on these work at home schemers. They carried out over 200 successful apprehensions and close downs of work at home schemes that defrauded many thousands of Californians and others across the country. The law enforcement sweep was entitled Project Biz Opp Flop and coordinated the efforts of police officials in 13 different states as well as federal agencies. The FTC, the U.S. Department of Justice and the U.S. Postal Inspection Service all helped with apprehension and enforcement. Charges included both civil and criminal violations of consumer protection and fraud laws. Charges were brought against work at home schemers in 24 states in the United States and in Canada as well. Most were apprehended in Florida, Arizona and California. The primary work at home schemes that Project Biz Opp Flop shut down where fraudulent business opportunity scams involving sale of vending machines that sold prepaid debit cards and phone cards. Those found guilty were forced to make restitution to the defrauded victims and were required to pay stiff civil penalties as well. Violations by four of these work at home schemes were referred to DOJ because of criminal franchise practices. In California, for instance, those who sell franchises must register with the state Department of Corporations. While at first glance it doesn’t seem like a work at home scam, and many people who think there’s a possibility it is go ahead and plunk down their money because the fee is small enough to be low risk. The reason this dot con joins the ranks of work at home scams is because the market is overly saturated and sales won’t be plentiful, no one has any protected territory so the entrepreneur is competing with everyone else that fell for the same work at home scam, the product or products may not exist or may be so low quality that complaints and returns are the norm and repeat customers non-existent. The other issue is that these work at home scam artists lead business owners to believe that that Web site will draw customers like flies when in fact bringing consumers to the site requires time consuming and often costly search engine optimization, advertising and affiliation efforts. None of which the potential owner ever hears from the vendor of the work at home scams. These work at home scams offer one potentially lucrative product – the sale to others of the same work at home scam procedure. While most small home business owners want to present themselves at first as one of the big guys, a client that is dropping in to finally meet the entrepreneur he or she has talked to so often will probably be pleased to learn of the small home business. One of the local banks in Namibia put out a strenuous warning to illegal money makers who were running the new pyramid schemes. The bank called on the help of the public to aid in enforcing the country’s law by reporting these pyramid schemes to the bank. The announcement also asked the country’s leaders and other influential civilians to aid in teaching others the detrimental effects of these pyramid schemes on its victims, especially those who lived in poverty-ridden areas. The illegality of the pyramid banking schemes, according to the bank announcement, was a violation of its Banking Institutions Act’s Section 5 which says that no one can receive, accept, advertise, take or solicit public deposits without being a registered banking institution. What makes these scams qualify as pyramid schemes is that the primary money making activity of them is the successful hiring of others to pay for the opportunity to join the pyramid. In investigating the work at home schemes, bank officers and other government officials found many of the perpetrators were from other neighboring countries. Some had been closed down in prior years but were beginning to crop back up again in newspaper ads. Some were direct marketed, though, while others were solicited face to face by those already in the pyramid scheme and trying to build their own pyramid under them to make their money. What the bank and the country officials determined is that people were making money in the pyramid schemes until and unless someone doesn’t deposit the required money or recruit new people. Then the pyramid doesn’t support everyone in it and begins to crumble. The bank blamed the success and prevalence of pyramid schemes in the country partly on its high unemployment rate. The consequence, unfortunately, they said, was to make poor people poorer and reward only the few that started the pyramid schemes in the first place. The fine in South Africa for pyramid schemes, besides financial penalty, is up to ten years in prison. Network Marketing Death Knell?Copyright © Roderick Eash http://www.TheEashSyndicate.comThe U.S. Federal Trade Commission (FTC) has proposed new legislation that would, according to some, protect consumers from fraudulent network marketing business schemes, but according to the network marketing industry leaders might sound the death knell of legitimate multi level marketing businesses. The proposed legislation, about which the FTC will take consumer comments until mid July 2006, is being called Business Opportunity Rule R511993. This proposed law that targets network marketing business would create new definitions for the terms business assistance, earnings claims, and business opportunity, broadening the language so that it includes a lot of common business practices that don’t know fall under the business opportunity category. It would require that a network marketing business representative provide a detailed and factual statement of disclosure a minimum of seven days before any prospect contracts with or pays the network marketing business provider. The legislation would also require that the network marketing business disclose in the statement any prior lawsuits, the statistics on prior contractors that had cancelled their contracts with the business within two years of signing, and a reference list. The latter would be those who purchased or contracted with the network marketing business in the prior three years. An additional require in this business opportunity legislation is disclosure to prospective purchasers of a statement of earnings claims that would have extensive information on earnings, with frequent updates. Network marketing executives and association representatives believe that the business opportunity legislation would negatively affect the entire industry and require multi level marketing first to change their sales methods to comply. The claim of these network marketing managers is that the requirements would be burdensome and oppressive for the firms and the distributors and that buying cars, large appliances and even assault weapons or hand guns would be more easily accomplished than becoming a network marketing business distributor. These MLM executives are beseeching distributors and other interested parties to write to the FTC and express their dismay with this proposed business opportunity legislation. They are convinced that passage of the bill would set off unnecessary alarms about the legitimacy of network marketing businesses and the way they compensate their distributors. They state that the proposed legislated procedures would be a violation of distributor privacy, would be time consuming and would lead to the loss of interest on the part of enthusiastic prospects. The claim of these network marketing business leaders is that this FTC legislation would increase considerably the costs of doing business for not only the multi level marketing businesses themselves but the distributors as well.
